Charmaine’s practice includes handling litigation, criminal, international arbitration, mediation and corporate matters. Her experience in dispute resolution ranges across a wide variety of matters, such as employment issues, investment disputes, defamation, commercial disputes, and criminal matters. Charmaine has also successfully argued matters as lead counsel in hearings and trials before the State Courts and the High Court of Singapore.

Experience

Civil / Commercial Litigation

  • Assisting counsel in representing a company that provides services on online gaming platforms to commence a civil claim against an international digital payment platform.
  • Assisting counsel in advising a company based in the United States of America on the issues regarding a potential international dispute regarding the sale and purchase of goods and services, with a company based in Taiwan.
  • Assisting counsel in providing advice to an individual based in the United Kingdom on the issues regarding a potential claim against an individual based in Singapore.
  • Assisted in advising a director of a programming company registered in Puerto Rico in a potential dispute with a software and technology company involving the agreement for the sale and purchase of assets developed by the company.
  • Assisting counsel in representing Daisho Development Singapore Pte Ltd in the dispute against Architects 61 Pte Ltd regarding issues of misrepresentation and Urban Redevelopment Authority restrictions imposed on the parcel of land. (Daisho Development Singapore Pte Ltd v Architects 61 Pte Ltd [2020] SGHC 16)
  • Represented a homeowner in a renovation dispute against an interior design company. Successfully conducted the 2-day trial, in the State Courts, as lead counsel and obtained the full claim amount.
  • Assisting counsel in representing the defendant of a construction dispute in the High Court. The defendant was a construction company and the sub-subcontractor in a condominium project, to which the claimant was a subcontractor. Successfully defended, as lead counsel, in a summary judgment application made by the claimant.
  • Represented and advised a stone and marble supplier in multiple High Court disputes against a construction company, who was the main contractor for various projects, for monies owed for goods and services supplied.
  • Assisting counsel in representing a buyer of a mixed-use development in Singapore in the dispute against the developer of the said development in the High Court to, inter alia, set aside the Arbitration award. (BNX v BOE and another matter [2017] SGHC 289)
  • Assisting counsel in representing BNX in the applications before the Court of Appeal to adduce further evidence on appeal (BNX v BOE and another appeal [2018] 2 SLR 215).
  • Assisting counsel in representing an investment-holding company in the appeal to the Court of Appeal against the High Court’s decision, Asia-American Investments Group Inc v UBS AG (Singapore Branch) and another [2017] SGHC 113.

Criminal Law

  • Assisted in drafting and submitting representations to the Commercial Affairs Department on behalf of an individual under investigations for alleged cheating and/or corruption offences.
  • Assisted in drafting and submitting representations to the police on behalf of an individual under investigations for an alleged offence of outrage of modesty.
  • Represented and assisted an individual, Lui Wai Leong, who pleaded guilty to an attempted cheating charge (with one other charge taken into consideration) to obtain a lower sentence than submitted by the Prosecution.
  • Made representations and pleas in mitigation for offences such as cheating, attempted cheating, and housebreaking.

Defamation

  • Assisted in advising and defending an individual against defamation allegations made by a former business partner before court proceedings were commenced.
  • Assisted in advising a member of a committee on issues regarding the viability of a potential defamation claim against another individual.

Corporate Experience

Charmaine also has experience in advising local and international clients for their corporate needs.

  • Advised a client on the processes, issues, and consequences arising out of the liquidation of a company in the business of selling wholesale frozen meat.
  • Advised a local corporate client in the business of home automation products on the terms and conditions of a distributorship agreement with an air-conditioning manufacturer.
  • Assisted in advising a Canadian company on the proposed acquisition of a Singapore-registered company in the business of wholesale medical supplies, including the drafting of the sale and purchase agreement.

Networks

Charmaine is currently serving her second term as the Programmes Chairperson of the Singapore Business and Professional Women’s Association (SBPWA). As part of a larger International Federation of Business and Professional Women, SBPWA is a not-for-profit organisation that focuses on developing and promoting the professional and business potential of women through projects organised locally and its global networks.
